Prescription Drug Injuries

Penicillin was one of the first “miracle drugs” of modern medicine. With penicillin doctors had a silver bullet to fight infections that killed hundreds of thousands of people a year.

Today, the drug industry is a powerful political and economic force. At its best, it develops and produces drugs that contribute to our longevity, health and wellness. At its worst, the pharmaceutical industry will release a drug before it has been properly tested; will tweak research results to hide negative side-effects; or will fail to warn doctors or the public of serious health risks associated with its use.

For various reasons the approval of a drug by the Food and Drug Administration does not always guarantee that it is safe, which is why we frequently hear of the FDA pulling a drug off the market after many people have died or been injured by a particular medication.

Common Types of Cases

There are many drugs that have been related to crippling or deadly outcomes. Generally these results could have been avoided if the proper precautions had been taken. Some of examples of these are:

  • Vioxx and other anti-inflammatory drugs;
  • Neurontin, a drug only approved by the FDA for two uses but allegedly marketed by Pfizer for unapproved uses that could be deadly;
  • Ephedra;
  • Rezulin, used to treat Type II diabetes;
  • Phenylpropanolamine (PPA), used in weight loss and nasal decongestion products;
  • Zyprexa, an anti-psychotic medication.

There are strict time limits you must meet to file a lawsuit. These time limits are complex and strictly enforced by the courts. It is in your best interest to speak to an attorney as soon as possible.

Though we understand that this is an excruciatingly difficult time for you, please be aware that it is critical that an investigation into the facts of the case be undertaken as soon as possible if you are considering filing a lawsuit. This is necessary to preserve evidence, to get information while memories are fresh, and to avoid losing your right to bring a lawsuit.

Reasons to File a Case

You not only deserve to be compensated for your pain and suffering and the loss of enjoyment of life, but, most importantly, you deserve to be free from your new financial hardships. You may no longer be able to work to support yourself and your family, to pay for your mounting medical bills, or to afford the extra costs of hiring help to do what you can no longer do around the house. Payment for your or a family member’s injuries or for the unnecessary death of a loved one is often critical to your and your family’s future.

Yet in most cases you will face an army of lawyers, an entire department at an insurance company, and the resources of a mega-corporation fighting against you to avoid providing you the money you desperately need. In other words, their whole focus is to avoid claims or to settle with you for the least amount of money possible.
