Defective Medical Devices

We live in a fast-paced world in which the uses for technology are expanding rapidly, especially in the medical field. Many of these medical devices give hope and a better life to thousands of people each year.

However, when a poorly designed or improperly tested medical device is released into or allowed to remain in the marketplace, it can do tremendous harm to many, many people.

In cases where a device is rushed to market before a device is proven to be safe and effective or when unsafe aspects of the device are ignored, tragedy can result and an unsuspecting patient can be severely hurt.

Also, a medical device may be safe if used in a specific way, but dangerous if you are not warned of their potential dangers.

Common Types of Cases

Defective medical device cases may include:

  • pacemakers that stopped or failed to keep a proper heart rhythm;
  • heart valve implants that leak or fracture causing repeated surgeries or death;
  • defective hip replacement parts;
  • infections caused by improperly made or not sterilized devices;
  • improperly sterilized gynecological devices that can cause infection, infertility or miscarriages.
  • breast implants or any other device that can cause damage to the immune system;
  • any malfunctioning device, such as insulin pumps.

There are strict time limits you must meet to file a lawsuit. These time limits are complex and strictly enforced by the courts. so it is in your best interest to speak to an attorney as soon as possible.

Though we understand that this is an excruciatingly difficult time for you, please be aware that it is critical that an investigation into the facts of the case be undertaken as soon as possible if you are considering filing a lawsuit. This is necessary to preserve evidence, to get information while memories are fresh, and to avoid losing your right to bring a lawsuit.

Reasons to File a Case

You not only deserve to be compensated for your pain and suffering and the loss of enjoyment of life, but, most importantly, you deserve to be free from your new financial hardships. You may no longer be able to work to support yourself and your family, to pay for your mounting medical bills, or to afford the extra costs of hiring help to do what you can no longer do around the house. Payment for your or a family member’s injuries or for the unnecessary death of a loved one is often critical to your and your family’s future.

Yet in most cases you will face an army of lawyers, an entire department at an insurance company, and the resources of a mega-corporation fighting you in order to avoid providing you the money you desperately need. In other words, their whole focus is to avoid claims or to settle with you for the least amount of money possible.
